Liability Disclaimer & User Responsibility Agreement

1. Nature of the Protocol

Velixr is open-source software and a decentralized protocol. It is NOT a financial institution, bank, broker, or licensed investment advisor.

Velixr provides infrastructure code that enables autonomous agents to communicate, authenticate, and settle transactions across networks. The protocol itself has no custody of assets, no control over user funds, and no ability to modify or reverse transactions once they are cryptographically committed.

The Velixr team creates the protocol layer—the "roads" upon which agents operate. We do not drive the cars. We do not control what agents do, where they route transactions, or how users deploy them.

2. No Warranty (AS-IS)

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

Including but not limited to the warranties of MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE and NONINFRINGEMENT. In no event shall the authors or copyright holders be liable for any claim, damages or other liability, whether in an action of contract, tort or otherwise, arising from, out of or in connection with the software or the use or other dealings in the software.

This disclaimer follows the MIT License under which Velixr is released. You are granted full freedom to use, modify, and distribute the code—and full responsibility for doing so safely.

3. User Responsibility

Users are solely and exclusively responsible for:

  • Every agent they design, code, compile, or deploy
  • Every transaction value and data transmitted through their agents
  • The security and safekeeping of all private keys and cryptographic material
  • Compliance with all applicable laws and regulations in their jurisdiction
  • Auditing and testing their agents before deployment in production environments
  • Monitoring the behavior of deployed agents and responding to anomalies

If you deploy an agent that causes harm—whether through bugging logic, exploited vulnerabilities, or malicious intent—you alone are responsible. The Velixr team did not write your agent code. We did not deploy it. We did not authorize its actions.

4. Limitation of Liability

The creators, maintainers, and distributors of Velixr are NOT liable for:

  • Lost, stolen, or inaccessible funds or cryptocurrency
  • Compromised, lost, or leaked private keys (regardless of cause)
  • Data breaches caused by quantum computing attacks or cryptanalytic advances
  • Agent behavior bugs, logical errors, or unintended side effects in user-written code
  • Network failures, transaction reversions, or consensus attacks on the underlying blockchain
  • Smart contract vulnerabilities or exploits in third-party integrations
  • Regulatory fines, sanctions, or legal consequences from misuse of the protocol
  • Any indirect, incidental, special, consequential, or punitive damages

In no event shall Velixr's total cumulative liability exceed $0 (zero dollars), because Velixr is an open-source protocol with no profit model, no control over its use, and no ability to prevent harm caused by third-party deployments.

5. Assumption of Risk

By using Velixr, you explicitly acknowledge and assume the following risks:

  • Technical Risk: The protocol may contain undiscovered bugs or vulnerabilities
  • Cryptographic Risk: Post-quantum attacks may render encryption obsolete
  • User Error Risk: You alone control your keys and agents—mismanagement is your liability
  • Regulatory Risk: Laws around autonomous agents and smart contracts are evolving and unclear
  • Market Risk: Asset prices, liquidity, and value may fluctuate or collapse unexpectedly

If you cannot accept these risks, do not use Velixr.

6. Modification & Termination

Velixr is a decentralized protocol. The core code is immutable once deployed on the network. However, the Velixr team reserves the right to:

  • Publish updated versions of the protocol software
  • Deprecate outdated or insecure versions
  • Publish security advisories or guidance
  • Cease maintenance and support at any time

Use of old or deprecated versions is entirely at your own risk. You are responsible for staying informed about protocol updates and security announcements.

7. Summary: We Build the Infrastructure, Not Your Agent

Velixr is infrastructure code—like TCP/IP or HTTP. We provide the protocol. We do not:

  • Write your agent code
  • Deploy your agents
  • Control your private keys
  • Manage your assets or data
  • Guarantee outcomes of any transactions

If something goes wrong, it is your responsibility to fix it—not ours.
